Acceptance of Terms
By creating a Botphonic account or using the Botphonic platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Use of the Service
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to make calls or send messages in violation of applicable laws, including the Telephone Consumer Protection Act (TCPA) in the United States
- Transmit spam, unsolicited, or harassing communications
- Impersonate another person or entity
- Attempt to gain unauthorized access to the platform or other users' accounts
- Reverse-engineer or attempt to extract the source code of the platform
- Use the Service to transmit malicious code or interfere with platform operation
Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Ensuring all users you add to your account comply with these Terms
- Obtaining all necessary consents from call recipients where required by law
Acceptable Use Voice Calling
When using Botphonic for outbound voice calls, you must comply with all applicable telemarketing and consumer protection laws in every jurisdiction where you operate. In the United States, this includes but is not limited to:
- Honoring Do Not Call (DNC) registrations
- Calling only within permitted hours (8 AM–9 PM local time of the recipient)
- Providing a clear opt-out mechanism at the start of each call
- Maintaining records of consent where required
Botphonic provides DNC scrubbing and calling hour enforcement tools, but ultimate legal compliance responsibility rests with you.
Data and Privacy
Your use of data in connection with the Service is governed by the Privacy Policy. By using the Service, you agree to the collection and use of data as described therein.
Service Availability
Botphonic targets 99.9% uptime (99.99% for Enterprise SLA customers) but does not guarantee uninterrupted service. Scheduled maintenance windows are announced in advance via the status page.
Intellectual Property
All platform software, interfaces, and documentation are the intellectual property of Botphonic. You retain ownership of content you upload (scripts, knowledge base documents, contact data). By uploading content, you grant Botphonic a limited license to process and store that content solely to provide the Service.
Termination
We reserve the right to suspend or terminate your access to the website at our sole discretion, without notice or liability, for conduct that we believe violates these Terms or is harmful to other users of the website.
Limitation of Liability
To the maximum extent permitted by applicable law, Botphonic's total liability to you for any claims arising from use of the Service shall not exceed the amounts paid by you in the 12 months preceding the claim.
Governing Law
These Terms are governed by the laws of the jurisdiction stated in the official Terms document at botphonic.ai/terms-condition (opens in a new tab).
Changes to Terms
Botphonic may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
